1. Who you are contracting with
Bardiah ("Bardiah", "we", "us") is operated by Sindibad Al Bokali (the "Seller"). These Terms of Service form a binding agreement between you and Sindibad Al Bokali covering your access to and use of the Bardiah website, application and related services (the "Service").
If you are entering into these terms on behalf of a company or other organisation, you confirm you have authority to bind that organisation. If you are contracting as an individual, you confirm you are of legal age in your jurisdiction.
2. Acceptance of these terms
By creating an account, purchasing a plan, or continuing to use the Service, you agree to these terms. If you do not agree, do not use the Service.
3. What Bardiah provides
Bardiah is an email design tool. It stores your brand assets (logo, colours, typography, voice references), lets you design and edit marketing emails, and exports production-ready HTML. Optional AI assistance can help draft or refine copy inside the design flow.
We grant you a limited, non-exclusive, non-transferable right to use the Service within the limits of the plan you have selected.
4. Your account
- You must provide accurate registration information and keep it up to date.
- You are responsible for keeping your credentials confidential.
- You are responsible for all activity that occurs under your account.
5. Acceptable use
You must not misuse the Service. In particular, you must not:
- use the Service for any unlawful purpose, or to send spam, phishing or fraudulent email;
- infringe the intellectual property, privacy or other rights of any third party;
- upload malware, probe or interfere with the security or integrity of the Service, or scrape it;
- reverse engineer, resell, redistribute, or circumvent technical or plan limits of the Service;
- generate content that is illegal, deceptive (including deepfakes), hateful, or harassing.
6. AI-assisted features
Some features use AI models to generate layouts, imagery suggestions or copy. You are responsible for your prompts, for the content you upload, for verifying accuracy, and for holding the rights to any material you input. AI output may be inaccurate and is not a substitute for professional, legal, financial or regulated advice.
We may remove or restrict content, filter or refuse outputs, and suspend accounts where content breaches these terms. Rights-holders can report infringing content to us at legal@bardiah.com; repeated infringement leads to account termination.
7. Intellectual property
Sindibad Al Bokali retains all ownership of the Service, including its software, documentation, design and branding. You retain ownership of the brand assets, copy and emails you create, and you grant us a limited licence to host and process that content solely in order to provide the Service to you.
8. Payment, subscriptions and taxes
Paid plans are billed monthly or annually in advance, at the price shown on our pricing page at the time of purchase. Subscriptions renew automatically for the same period unless cancelled before the end of the current term. Upgrades take effect immediately; downgrades take effect at the end of the current billing period.
Order processing and Merchant of Record. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms. Our own refund commitments are set out in our Refund Policy.
9. Service availability
We work hard to keep Bardiah available and reliable, but we do not guarantee that the Service will be uninterrupted, error-free, or free of defects. Maintenance, updates and third-party outages may affect availability.
10. Suspension and termination
We may suspend or terminate your access to the Service if:
- you materially breach these terms;
- payment for your plan fails or is not made;
- your use creates a security, legal or fraud risk;
- you repeatedly or seriously violate our acceptable use rules.
You may cancel at any time. On termination, your access ends and we will make your stored content available for export for 30 days, after which it may be deleted.
11. Warranties and liability
To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our aggregate liability is limited to the fees you paid in the 12 months before the claim. Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.
12. Indemnity
You will indemnify Sindibad Al Bokali against claims arising from your content, your unlawful use of the Service, or your breach of these terms.
13. General
You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control. These terms are governed by the laws of the Kingdom of Saudi Arabia, and the courts of Jeddah have exclusive jurisdiction, unless mandatory local law in your country of residence says otherwise.
